The Lahore High Court has issued a significant 14-page ruling regarding 'Haq Mehr' (dower), rejecting a petition filed by a former husband, Arsalan, who sought to avoid paying the dower to his ex-wife. Justice Mohsin Akhtar Kayani upheld the Family Court's decision, affirming that the Family Court possesses the authority to order dower payments, and a woman's right to dower is not nullified simply because she initiates a divorce (khula). The court's decision highlighted that physical, mental, emotional, and economic abuse constitute 'zulm' (cruelty), and a wife's credible testimony can suffice to prove such cruelty. Furthermore, the court emphasized the need for new legislation concerning dower laws, underscoring its importance in current legal frameworks.
